Understanding The Basics Of Custody

For some parents, establishing custody will begin with establishing paternity. For others, it can begin right away with negotiating.

Generally speaking, there are two elements to custody: residential schedule and decision-making. Residential schedule determines who is with the child and when. If you are not the child’s primary caretaker, your physical custody time may be referred to as “visitation” or “parenting time.” Decision-making determines who has the power to make legal decisions for the child. This may be split between parents, who will then jointly decide things like the child’s schooling or medical care. It can also be limited to just one parent.
